Universal files lawsuit against "Fifty Shades" porn "rip-off"

LOS ANGELES (Reuters) - Hollywood's Universal Studios has filed a copyright lawsuit against a porn production company, accusing it of lifting language, characters and plot from the best-selling erotic book trilogy "Fifty Shades of Grey" for its own adult films and sex toys.

Calling one of the adult movie adaptations of the British novel "a rip-off plain and simple," Universal's lawsuit seeks to stop sales of copycat porn movies and to recoup any profits they earn.

"Fifty Shades of Grey" by E.L. James and its two sequels have sold more than 40 million copies since first being published in 2011. Universal bought the rights for a film adaptation earlier this year for a reported $5 million.

The suit was filed jointly in federal court in California on Tuesday by Universal and James's British company which owns the copyright to the novels.

The lawsuit said that Los Angeles-based based Smash Pictures had produced a movie called "Fifty Shades of Grey: a XXX Adaptation" which lifted "exact dialogue, characters, events, story, and style from the 'Fifty Shades' trilogy."

"The first XXX adaptation is not a parody, and it does not comment on, criticize, or ridicule the originals. It is a rip-off, plain and simple," the lawsuit added.

Smash Pictures could not be reached for comment.

Universal said Smash Pictures had two subsequent movies in production and that one of its subsidiaries had also launched a "Play Kit" of kinky sex toys called "Fifty Shades of Pleasure."

The lawsuit seeks an injunction, unspecified damages, and profits from sales of the movies, which it says are trademark and copyright infringements.

Hackers didn't steal info on Iran's nuclear program, agency says

VIENNA (Reuters) - The head of the U.N. nuclear agency said on Thursday a hacking incident involving one of its servers was "deeply regrettable" but suggested that no sensitive information related to Iran's atomic activities had been stolen.

Yukiya Amano said the hacking - first reported by the International Atomic Energy Agency (IAEA) on Tuesday - had happened several months ago and that the server concerned had been closed down.

The hackers - a group using an Iranian-sounding name - on Sunday posted scores of email addresses of experts who have been working with the U.N. agency on a website, and urged the IAEA to investigate Israel's nuclear activity.

The U.N. agency did not say who it believed might have been behind the hacking. There has been an increase in suspected Iranian cyber attacks this year, coinciding with a deepening standoff with the West over Tehran's nuclear program.

The most worrying, experts say, were those on Saudi oil firm Aramco - effectively destroying tens of thousands of computers - and Qatari gas export facilities.

Iranian officials have tended to deny involvement. But they say they have continued to come under cyber assault themselves, with systems at Iran's own oil facilities, communications and infrastructure firms suffering problems last month.

Major breakthrough in deciphering bread wheat's genetic code

ScienceDaily (Nov. 28, 2012) ? Scientists, including Professor Keith Edwards and Dr Gary Barker from the University of Bristol, have unlocked key components of the genetic code of one of the world's most important crops. The first analysis of the complex and exceptionally large bread wheat genome, published today in Nature, is a major breakthrough in breeding wheat varieties that are more productive and better able to cope with disease, drought and other stresses that cause crop losses.

The identification of around 96,000 wheat genes, and insights into the links between them, lays strong foundations for accelerating wheat improvement through advanced molecular breeding and genetic engineering. The research contributes to directly improving food security by facilitating new approaches to wheat crop improvement that will accelerate the production of new wheat varieties and stimulate new research. The analysis comes just two years after UK researchers finished generating the sequence.

The project was led by Neil Hall, Mike Bevan, Keith Edwards, Klaus Mayer, from the University of Liverpool, the John Innes Centre, the University of Bristol, and the Institute of Bioinformatics and Systems Biology, Helmholtz-Zentrum, Munich, respectively, and Anthony Hall at the University of Liverpool. W. Richard McCombie at Cold Spring Harbor Laboratory, and Jan Dvorak at the Univerisity of California, Davis, led the US contribution to the project.

The team sifted through vast amounts of DNA sequence data, effectively translating the sequence into something that scientists and plant breeders can use effectively. All of their data and analyses were freely available to users world-wide.

Professor Keith Edwards said: "Since 1980, the rate of increase in wheat yields has declined. Analysis of the wheat genome sequence data provides a new and very powerful foundation for breeding future generations of wheat more quickly and more precisely, to help address this problem."

The analysis is already being used in research funded by the Biotechnology and Biological Sciences Research Council (BBSRC) to introduce a wider range of genetic variation into commercial cultivars and make use of wild wheat's untapped genetic reservoirs that could help improve tolerance to diseases and the effects of climate change. The wheat breeding community and seed suppliers have welcomed the research.

The sequence data has been deposited at the European Nucleotide Archive and is also available from databases in the UK and Germany.

Researchers from the European Bioinformatics Institute, Kansas State University, and the United Sates Department of Agriculture were also vital to the project's success. The research was possible thanks to major funding was form the Biotechnology and Biological Sciences Research Council (BBSRC), the EU and the National Science Foundation (NSF).

Professor Douglas Kell, BBSRC Chief Executive, said: "In the face of this year's wheat crop losses, and worries over the impact on prices for consumers, this breakthrough in our understanding of the bread wheat genome could not have come at a better time. This modern strategy is a key component to supporting food security and gives breeders the tools to produce more robust varieties with higher yields. It will help to identify the best genetic sequences for use in breeding programmes."

David Willetts, Minister for Universities and Science said: "This groundbreaking research is testament to the excellence of Britain's science base and demonstrates the capability we want to build on through the agri-tech strategy currently being developed. The findings will help us feed a growing global population by speeding up the development of new varieties of wheat able to cope with the challenges faced by farmers worldwide."

GL Iraq Could Dominate Middle Eastern Energy Output by 2030

Iraq could develop its oil and gas infrastructure quickly enough to dominate Middle Eastern energy output within 18 years, according to a poll of industry professionals at the ADIPEC Exhibition and Conference in Abu Dhabi.

According to the survey held by global independent technical advisor to the oil and gas sector GL Noble Denton, 65% of participants said that Iraq has the potential to develop its energy infrastructure at such a pace that it will dominate the region?s output by 2030.

By contrast, 35% of participants thought that inadequate facilities, a disadvantaged economy and an under-developed regulatory framework ? among other issues ? could prevent the country from expanding its oil and gas footprint at speed.

A study published by the International Energy Agency last month suggests that Iraq has the potential to reshape the global energy industry in the near future. According to the report, an increase in oil exports could add a cumulative USD $5 trillion to the country?s economy over the next two decades; a number that would grow its gross domestic product five-fold.

Moss Daemi, GL Noble Denton?s Executive Vice President for the Middle East and Africa, said: ?Iraq?s oil and gas industry shows huge promise, but the country has some major infrastructure challenges to overcome if it is to realise its potential. The result of this poll shows that industry professionals are extremely optimistic that the country will be able to tackle those issues.

?With the support of experienced international and regional players, there is every possibility that Iraq?s oil and gas industry can develop a significant infrastructure in a short period of time.?

GL Noble Denton also surveyed ADIPEC delegates? opinion over the United Arab Emirates? (UAE) potential to become energy self-sufficient, and whether the country is investing enough money in maintaining the integrity of its assets.

The poll revealed that oil and gas professionals think the UAE will produce enough gas to fuel its growing domestic energy demands by 2030. 81% of participants said that the development of new gas recovery projects will meet the UAE?s rising demand for the commodity and make the country energy self-sufficient by 2030. By contrast, 19% of participants thought that the UAE will need to continue relying on gas imports to sustain domestic energy consumption over the next 18 years.

Industry professionals also believe that the UAE is making the right investments in asset integrity to meet the country?s rising challenges in production from established oil fields. According to GL Noble Denton?s poll, 72% of participants said that the country?s oil and gas industry is spending sufficiently on optimising asset integrity, as facilities are increasingly called upon to operate beyond the lifespan for which they were originally designed. Only 28% of participants thought that the industry is under-investing in asset performance in the Emirates.

Middle East 'Cern' taking shape

David Shukman spoke to scientists from different countries in the region about what the project means to them

Amid rising tensions in one of the world's most volatile regions, an audacious project to use science for diplomacy is taking shape in the heart of the Middle East.

In this land of ancient hatreds, a highly sophisticated scientific installation is being built in Jordan.

It has support from countries that are usually openly hostile to each other.

The plan is for a multi-million-pound synchrotron particle accelerator, known as Sesame.

It has backing from several Arab nations, together with Turkey, Pakistan, Cyprus, Iran and - astonishingly - Israel as well.

The Iranian government is publicly committed to Israel's destruction and Israel has threatened to bomb Iran's nuclear facilities. And most recently Israel accused Iran of supplying Palestinian militants with the missiles launched at Israeli cities.

Yet the governments of both these countries and others have pledged to provide more funding to Sesame, and BBC News witnessed their scientists and officials meeting for lengthy discussions in Jordan earlier this month.

After years of doubts about the project's feasibility, construction is now at an advanced stage and most of the next round of finance is secured. The first science could start as early as 2015.

The synchrotron, which acts in effect like a giant microscope, will be used by researchers to study everything from viruses to new drugs to novel materials.

Synchrotrons have become an indispensable tool for modern science with some 60 in use around the world, almost all of them in developed countries, and this will be the first in the Middle East.

No barriers

The goal of fostering advanced research in the region - and opening a new path of dialogue - was first suggested back in the 1990s. Just as Cern was set up after World War Two to bring together scientists from former adversaries in Europe, Sesame is meant to allow researchers to collaborate across the Middle East.

The governing council of Sesame is headed by a British physicist, Prof Sir Chris Llewellyn Smith, a former director of Cern, which operates the Large Hadron Collider from Geneva in Switzerland.

During a visit to the facility, in the hills 20 miles northwest of Amman, he told BBC News: "It is pretty remarkable but it's happened and it's because the scientific communities in these countries have pushed for this and ignored the political barriers.

"Science is a common language - if we can speak it together, possibly we can build bridges of trust which will help in other areas."

Sesame stands for Synchrotron-light for Experimental Science and Applications in the Middle East. And it is also a reference to the famous phrase "open sesame", the secret command to open a treasure trove in the tale of Ali Baba and the Forty Thieves.

Despite immense political sensitivity, the project has already been opening new channels of communications so effectively that the prospect of the machine being commissioned is now a tangible possibility.

The most recent meetings of the "users" - the scientific teams who hope to make use of Sesame - and of the technical advisers and governing officials took place earlier this month in Jordan.

'Dare to believe'

The BBC was given exclusive access to the synchrotron construction site and to the gatherings - and the degree of harmony was striking.

Delegates from Cyprus and Turkey (which do not have diplomatic relations) and from Israel, Iran and Pakistan (the latter two having no relations with Israel) sat together, alongside Jordanians, Palestinians and Egyptians. Given the degree of tension at a political level, the atmosphere was amazingly calm and businesslike.

According to Prof Eliezer Rabinovici, a physicist from the Hebrew University of Jerusalem, the project is "a beacon of hope for many people in the area who dare to believe" that life in the region can be improved.

"We are having a rough period now - a very rough period - and it may become even rougher.

"But I think that as scientists, we have to look at the long range, and in the long range we see no conflict of interest between the people of Iran and the people of Israel."

His sentiments were echoed by one of the senior scientists from Iran, Prof Mahmoud Tabrizchi from Isfahan University, who told me: "Every scientist needs tools to work with and train his or her students but it costs a lot to buy instruments, especially good instruments. But this machine covers a large percentage of the needs of the scientists of this region.

"This is kind of helping each other to have a big machine to help everybody, the purpose of Sesame is to bring scientists to work together."

The next stage of construction is being funded with $5m each from Israel, Iran, Jordan and Turkey plus another $5m from the EU for Cern to provide the magnet system. Pakistan has agreed to provide $5m in kind.

That still leaves a $10m shortfall in funding to improve the "beamlines" - the parts of the synchrotron where research is actually carried out - and provide accommodation for visiting scientists.

Way forward

Synchrotrons work by accelerating electrons around a circular tube, during which excess energy is given off in the form of light - from X-rays to infrared - which is diverted into the beamlines. By focusing the intense light onto samples, the tiniest structures can be mapped in great detail.

The idea for Sesame got off the ground when a German synchrotron known as Bessy was being dismantled and a Stanford University professor, Herman Winick, suggested it should not be scrapped but shipped to the Middle East instead.

Prof Winick points to the role of synchrotrons in Brazil, South Korea and Taiwan in generating local scientific expertise and reversing the "brain drain" of talent and says a similar effect is possible in the Middle East.

He told me that Sesame could already be judged a success simply because preparatory meetings over the past decade have brought together scientists from countries that would never normally meet.

"Even if Sesame does not produce an X-ray or produce research, it has done immense good in this region.

"That's exemplified by the users' meetings in which a hundred or more scientists from this region get together and meet."

That view is shared by many of the scientists taking part in a project seen as having a value far beyond science.

Dr Jamal Ghabboun, a Palestinian physicist from Bethlehem University, said he had never imagined that he could collaborate in this way.

"What we hope is that science will open the door to further understandings concerning other issues - we will begin with science and somehow we will open the doors that are closed for years or centuries."

Prof Zuheir El-Bayyari of Philadelphia University in Jordan described science "as a wonderful thing to collaborate on".

"With science we can have a message of peace, of being humans dealing with each other on this basis, to have the knowledge for the benefit of all civilisation and our world in general," he said.

Political challenges

For Maedeh Darzi, a young woman science graduate from Iran, the visit to Jordan was her first abroad and, as with many here, her first encounter with Israelis.

She said Sesame was "a modern technology which will help people around the Middle East to develop and improve their knowledge".

I asked Prof Roy Beck of Tel Aviv University how he felt sitting with Iranian scientists when their government had vowed to destroy his country.

"Well, Iranian scientists have not vowed to destroy me," he said. "I mean, Iranian and Palestinian and Pakistani scientists are my friends because they are scientists so we have a common ground. This is really the essence of what Sesame can bring to the region."

The project still faces technical challenges, on top of the constant threat of political breakdown or conflict forcing the key countries to pull out or cancel their funding.

Prof Llewellyn Smith admits that there are plenty of uncertainties ahead: "Certainly a real war would stop us in our tracks but we've got to be optimistic and keep going."

And despite the recent conflict involving Israel and Hamas militants in Gaza, there is no sign so far of any country withdrawing.

Prof Zehra Sayers of Sabanci University in Istanbul says Sesame is so valuable that it cannot be allowed to fail.

"Maybe it will not bring peace to the region, but it can bring one small line of communication to the people who live in this area," he said.

"This is why it has to work. We need those tiny thin fragile lines of communication."

European banks urge one-year delay for Basel III rules

GUBBIO, Italy (Reuters) - European banks have asked the European Commission to postpone the introduction of tougher global bank capital rules by a year to 2014 after U.S. regulators told lenders they did not expect the new regulations to take effect in 2013.

The tougher rules, known as Basel III, are the world's regulatory response to the 2007-09 financial crisis and would force banks to triple the amount of basic capital they hold in a bid to avoid future taxpayer bailouts.

The European Banking Federation sent a letter on November 21 to EU Internal Market Commissioner Michel Barnier, formally requesting a delay on the grounds that EU banks would be at a competitive disadvantage if they introduced the new rules before their U.S. counterparts.

"We are now very troubled over the possible repercussions that the most recent statement from the US Authorities may have for the international competitiveness of Europe's banks," the letter, made available to Reuters on Saturday, said.

It said EU banks were facing sweeping regulatory changes including new rules on capital requirements and liquidity buffers, and the creation of a EU supervisory authority.

"All the while, our US competitors will not have matching obligations imposed on them in parallel, or in a foreseeable future," it said, asking for the introduction of the new rules to be delayed to January1, 2014.

A spokesman for Barnier said the EU would seek a coordinated stance with the United States.

"We will wrap up negotiations in the coming weeks between countries and parliament (on Basel III) and Michel Barnier will seek clarity from the U.S. and work for a coordinated U.S.-EU approach. Basel 3 norms are important for sound and competitive banks in Europe."

The Basel III rules are meant to be phased in from January 2013 but U.S. regulators cast doubt on the timeframe due to a flood of industry comments on the proposals.

"Basel III must be postponed, full stop" said the head of Italy's banking association, Giuseppe Mussari, at a conference in the central Italian town of Gubbio.

"Clearly there is no worldwide agreement, so we wouldn't be starting on a level playing field."

Britain?s code-breakers acknowledged Friday that an encrypted handwritten message from World War II, found on the leg of a long-dead carrier pigeon in a household chimney in southern England, has thwarted all their efforts to decode it since it was sent to them last month.

As the bird?s story made headlines, pigeon specialists said they believed it may have been flying home from British units in France around the time of the D-Day landing in 1944 when it somehow expired in the chimney at the 17th-century home where it was found in the village of Bletchingley, south of London.

After sustained pressure from pigeon fanciers, Britain?s Government Communications Headquarters, its code-breaking and communications interception unit in Gloucestershire, agreed to try to crack the code. But on Friday the secretive organization acknowledged that it had been unable to do so.

?The sorts of code that were constructed during operations were designed only to be able to be read by the senders and the recipients,? a historian at the organization told the British Broadcasting Corporation.

?Unless we get rather more idea than we have about who sent this message and who it was sent to, we are not going to be able to find out what the underlying code was,? said the historian, who was identified only as Tony under the organization?s secrecy protocols.

Code breakers, he said, believed that there could be two possibilities about the encryption of the message, both of them requiring greater knowledge about the identity of those who devised or used the code.

One possibility, he said, was that it was based on a so-called one-time pad that uses a random set of letters, known only to the sender and the recipient, to convert plain text into code and is then destroyed.

?If it?s only used once and it?s properly random, and it?s properly guarded by the sender and the recipient, it?s unbreakable,? the historian said.

Alternatively, if the message was based on a code book designed specifically for a single operation or mission, then the code breakers were ?unlikely? to crack it, the historian said. ?These codes are not designed to be casually or easily broken.?

It took a campaign of many years to get officials to pay attention. The pigeon?s skeleton was initially found in 1982 by David Martin, a retired probation officer, when he was cleaning out a chimney at his home in Bletchingley as part of a renovation. The message, identifying the pigeon by the code name 40TW194, had been folded into a small scarlet capsule attached to its leg.

?Without access to the relevant code books and details of any additional encryption used, it will remain impossible to decrypt,? the Government Communications Headquarters said in a news release. ?Although it is disappointing that we cannot yet read the message brought back by a brave carrier pigeon, it is a tribute to the skills of the wartime code makers that, despite working under severe pressure, they devised a code that was undecipherable both then and now.?

Mr. Martin said he was skeptical of the idea that the agency had been unable to crack the code. ?I think there?s something about that message that is either sensitive or does not reflect well? on British special forces operating behind enemy lines in wartime France, he said in a telephone interview. ?I?m convinced that it?s an important message and a secret message.?

There was some indication on Friday, though, that the agency was not taking 40TW194?s code as seriously as, say, tracking satellite phone communications between militants in the Hindu Kush.

One of the most ?helpful? ideas about the code, according to Tony, the agency?s historian, had come from an unidentified member of the public. That person suggested that, with Christmas coming and thoughts turning, in the West at least, to a red-robed, white-bearded, reindeer-drawn bearer of gifts skilled at accessing homes through their chimneys, the first two words of the message might be ?Dear Santa.?

Greylock?s Simon Rothman Joins Apartment List Advisory Board As The Startup Looks Beyond Apartments

Simon Rothman @ GreylockApartment List, an apartment search engine that launched at TechCrunch Disrupt this fall, says that Simon Rothman, an executive in residence at Greylock Partners, has joined the company's advisory board. Rothman was founder and global vice president at eBay Motors, which he reportedly grew to a $14 billion annual global business accounting for one-third of eBay's revenue. He has a broader interest in building marketplaces, as outlined in a guest column for TechCrunch. And that's all relevant since Apartment List plans to expand beyond apartments into other types of marketplaces, including one for autos, in 2013.
